Privacy Policy

Last updated on 27 Dec 2023

RadiusAI, Inc. (“Company”) respects the privacy of the users of its Website whether users are simply viewing our Website or requesting to do business with us. The following Company privacy policy (“Privacy Policy”) is designed to inform you, as a user of the Website, about the types of information that we collect from you or the type of information you may choose to provide when visiting our Website. It also is intended to explain the conditions under which Company collects, uses, maintains, and discloses that information, and your rights in relation to that information. By using our Website, you agree to the terms of this Privacy Policy. This Privacy Policy may change from time to time, however, your continued use of the Website after we make changes is deemed acceptance of those changes. Accordingly, each time you use the Website you should check the date of this Privacy Policy (which appears at the end of this document) and review any changes since the last time you used the site. If you do not agree to our Privacy Policy, then please do not use our Website.

General Viewers of our Website

The Company does not collect any personal-identifying information or non-personally identifying information (subject to the statements below) from general users of our Website. “Personal-identifying information” (“PII”) is information that can be used to individually identify you as distinguished from a larger group, such as your name, email address, or telephone number. “Non-personally identifying information” (“Non-PII”) is information that, without additional information, cannot be directly associated with an individual person, such as an IP address, browser type, or location.

As a general user viewing our Website, the Company does not use Web Cookies, Web Beacons, Retargeting or Conversion Pixels, Embedded Web links, Google Analytics, or other automated tools to collect information about you. The Company platform is designed to capture and collect what is considered certain, limited non-PII. More specifically, our hardware collects pixel-level environmental information on fixed objects (i.e., a car driving into a gas station, a person walking into a building, etc.). Our AI platform aggregates and analyzes that environmental information against environmental information collected by the Company in previous encounters to recognize patterns, and then we generate confidence interval data as to whether a fixed object is recognized as the same fixed object as in one or more previous encounters. The confidence interval data cannot be used to distinguish, identify or trace an individual’s identity (no biometric records, etc.), and is only used to recognize, track, and help understand behaviors of fixed objects.

If so disclosed, our trusted business partners are under contract to keep your PII secure, to not use it for any reason other than to fulfill the services for the Company, and to not disclose the information to any third-party.

Other than as described above, we will not share your PII with any third-parties without your consent, unless it is under one of the following circumstances:

• By Law or to Protect Rights: The Company discloses PII (i) when required to do so by law, regulation, or in response to a subpoena or court order, (ii) in response to duly authorized information requests from law enforcement or other government authorities, (iii) while investigating, mitigating, or preventing security threats, fraud, or similar activity, or (iv) if the Company believes in its sole discretion that disclosure is reasonably necessary to protect the property, rights, or safety of the Company, its contractors, partners, affiliates, or employees.

• By Successors or Transfers of Company Property: If the Company in its sole discretion decides to buy, sell, expand, or reorganize its business in the United States or other selected countries, it reserves the right to share or transfer all PII in its possession to any actual or prospective partners, affiliates, or successors. In any such circumstance, your previously collected PII will continue to be subject to this Privacy Policy or a new updated Privacy Policy that is posted on the Company Website (from which you may opt out). In the event that the Company is subject to bankruptcy, your PII will be subject to any applicable court order.
